Terms and Conditions of Sale
GENERAL
These Terms and Conditions of Sale apply to all purchases and orders of products or services made with Studio Habitat d.o.o., Trubarjeva ulica 2, 2000 Maribor, Slovenia (hereinafter referred to as the “seller”), regardless of whether the order is placed in person, by email, or via the website. By placing an order, the buyer confirms that they have read and agree to these terms.
BUYER
The buyer may be a natural person or a legal entity. A natural person acts as a consumer when the products or services are not used for commercial or professional purposes. The information provided by the buyer when placing the order must be accurate and truthful.
PRICES
All prices are expressed in euros (EUR) and include VAT, unless otherwise explicitly stated. The prices indicated on the pro forma invoice and/or published on the website at the time of order placement apply. The seller reserves the right to change prices without prior notice; however, the price valid at the time of order placement will always apply to that specific purchase.
PAYMENT TERMS
Payment is made on the basis of the issued pro forma invoice. The payment deadline is specified on the pro forma invoice. In case of non-payment within the deadline, the seller reserves the right to cancel the order. Products will only be ordered from the supplier after full or partial payment, as defined in the pro forma invoice, has been received.
DELIVERY TIMES
The delivery time depends on the manufacturer or supplier and is specified in the pro forma invoice. The period begins on the next working day after receipt of payment. The seller is not liable for delays caused by force majeure, production disruptions at the supplier, or delivery issues.
COLLECTION AND DELIVERY
Products can be collected in person at the seller’s premises or delivered to the agreed address. Delivery costs are not included in the price unless otherwise agreed in the pro forma invoice. Upon collection, the buyer must check the quantity and any visible damage to the goods.
CUSTOM ORDERS
All products offered by the seller are ordered exclusively based on the buyer’s selection and confirmation and are often customized to their specifications (dimensions, materials, colors, etc.). Therefore, the goods are not in stock and are ordered directly from the suppliers.
RIGHT OF WITHDRAWAL
In accordance with Article 43.c of the Consumer Protection Act (ZVPot), the buyer has no right to withdraw from the contract if the goods are made to the buyer’s precise specifications or customized to their personal requirements.
Since Studio Habitat d.o.o. orders all products exclusively based on the buyer’s confirmation and directly from the manufacturers, withdrawal from the contract after order placement is not possible.
COMPLAINTS AND MATERIAL DEFECTS
The buyer must report any defects in the products to the seller within the statutory period (no later than 2 months after discovering the defect). The seller is liable for material defects in accordance with the Consumer Protection Act (ZVPot) and the Obligations Code. Complaints must be submitted in writing, with a description of the defect and supporting evidence (e.g., photos). Defects resulting from improper installation, unsuitable use, or mechanical damage occurring after collection are not covered by the warranty.
LIMITATION OF LIABILITY
The seller is not liable for possible variations in color shades, material structure differences, or other minor deviations typical in production that do not affect the product’s functionality. Photos on the website are symbolic. The seller is not liable for damages resulting from delivery delays unless the delay is due to gross negligence by the seller.
ELECTRONIC COMMUNICATION
The buyer agrees that the seller may contact them via email regarding the progress of the order (order confirmation, notification of preparation for collection/delivery). Commercial notifications are sent only with the buyer’s consent.
PERSONAL DATA PROTECTION
The seller will protect all personal data in accordance with applicable law and the Privacy Policy published on the website.
DISPUTE RESOLUTION
In the event of a dispute, the seller and the buyer will endeavor to resolve it amicably. If an agreement is not possible, the competent court in Maribor shall have jurisdiction.
FINAL PROVISIONS
The seller reserves the right to amend these Terms and Conditions of Sale without prior notice. The terms published on the website at the time of order placement shall apply.
